Late Fee Litigation Update

A three-judge panel of the U.S. Circuit Court of Appeals in New Orleans ruled on June 18, 2024, that ongoing litigation tied to the U.S. Consumer Financial Protection Bureau’s (CFPB) $8 cap on credit card late fees must occur in federal court in Texas. The U.S. Chamber of Commerce and the American Bankers Association succeeded in having a federal court in Texas halt implementation of the fee cap. That decision was followed by a higher court ruling in Texas that moved additional appeals to federal court in Washington, DC. The New Orleans decision returns jurisdiction to Texas. The $8...
