Merchant Litigation Settlements Upended

U.S. District Court Judge Nicholas Garaufis has thrown out a 2013 agreement calling for American Express to pay up to $75 million in attorneys’ fees as part of a pending settlement of two class-action lawsuits brought by U.S. merchants against American Express. The suit involved Amex’s Honor All Cards Provisions and Non-discrimination Provisions. None of the money has been distributed because final approval has not been given by the court.
