Oral arguments from American Express and the U.S. Department of Justice (DOJ) were held December 17, 2015, in the Court of Appeals for the Second Circuit regarding Amex’s request to overturn a ruling by the U.S. District Court in February.
The U.S. District Court for the Eastern District had imposed a permanent injunction effective July 20, 2015, on enforcement of Section 3.2 of the American Express card acceptance agreement that, among other things, prohibited merchants from asking consumers to pay with an alternative brand of payment card.
