American Express has been fighting the United States Department of Justice (DOJ) in U.S. District Court for the Eastern District of New York since October 2010 when the DOJ and 17 U.S. states charged Visa, MasterCard, and Amex with violating antitrust law because their merchant acceptance agreements precluded offering consumers incentives for, or steering consumers to, alternative cards or payment methods, except as required by the Durbin Amendment.
